The purposes of processing personal data and the legal basis for processing

Patient's personal data can be processed for the following purposes: 

  • Providing health services and keeping medical records,
  • Verification of entitlements to obtain and settlement of completed healthcare services,
  • Communicating in matters related to the coordination of the provision of services, including, but not limited to, the organization of providing services, assessment of the patient's well-being after the provision of the service, patient satisfaction survey,
  • Performing other auxiliary activities when providing health services.based on the provisions of art. 6 par.  1 (b) and c (for "private" patients), art. 6 par.  1 (c) (for patients whose health services are financed under an agreement concluded with the National Health Fund) and art. 9 par.  2 (h) of the General Data Protection Regulation 2016/679 (GDPR), art. 3 of the Act on medical activity and art. 24 of the Act on patient’s rights and Patients Ombudsman and
  • Marketing goals, receiving commercial information, receiving an e-mail with a survey regarding the submission of opinions on the provided services, based on the consent of the patient (article 6, par. 1 (a) of the General Data Protection Regulation 2016/679 (GDPR)).

 

Providing personal data to the extent to which they are associated with the conclusion of the agreement for the provision of health services is voluntary and is a condition for the conclusion of the agreement. Providing personal data to the extent to which they are associated with the provision of health services, including the keeping of medical records, is a statutory requirement and is necessary for the proper provision of health services. 

 

Providing personal data to the extent to which they are related to marketing purposes, receiving commercial information, and receiving an e-mail with a survey regarding the submission of opinions on the provided services is voluntary.

 

Information about recipients of personal data

Personal data of MAVIT MC patients can be transferred to:

  • medical entities cooperating with CM MAVIT in order to ensure the continuity of treatment and the availability of health services,
  • providers of technical and organizational services that enable the provision of health services and keeping medical records, in particular to ICT service providers, suppliers and equipment service technicians, courier and postal companies,
  • persons authorized to obtain information about the patients’ health and planned and provided health services as well as persons authorized to obtain medical records,
  • entities authorized under the law,
  • suppliers of legal and advisory services and to entities supporting MAVIT MC in enforcement of due claims or defending rights (in particular law firms and debt collection companies).

 

The period of data storage

Patient's personal data, to the extent to which they are connected with the conclusion of an agreement for the provision of health services, are stored for the limitation period of possible claims.

Patient's personal data collected in medical records are stored for the medical records storage period required by the law.

 

Patients' rights in relation to the processing of personal data

Patients have the right to request access to their personal data, rectify them, delete or limit their processing or object to their processing and the right to data transfer.

If the processing of personal data is based on the consent of the patient, the patient has the to withdraw the consent at any time. The withdrawal of consent should not affect the lawfulness of the processing based on the consent before its withdrawal.

The right to request the rectification, deletion or limitation of the processing of personal data and the right to object to the processing of data contained in the medical records is vested in the patient unless it violates the Administrator's obligation to store medical records.

The purposes of processing personal data and the legal basis for processing

Personal data of persons authorized are processed in order to implement the authorization to obtain information about the patient's health and planned and provided health services and to obtain medical records, based on the provisions of art. 6 par. 1 (c) and (d) and art. 9 par. 2 (h) general regulation on data protection 2016/679 (GDPR) and.  § 8 par. 1 of the Ordinance of the Minister of Health of November 9th, 2015 on the types, scope and drafts of medical records and the manner of their processing.

 

Providing personal data is voluntary but necessary to complete the authorization.

 

Categories of personal data processed

The following personal data of persons authorized are processed: name and surname, telephone number or address and password in the case of persons who provided the password for identification by telephone.

 

Information about recipients of personal data

Personal data of patients of MAVIT MC may be transferred to entities authorized under the law and to technical and organizational service providers that enable the provision of health services and medical records, in particular to ICT service providers and courier and postal companies.

 

The period of data storage

Personal data of persons authorized are stored for the medical records storage period required by the law or until the patient's authorization is withdrawn.

Patients have the right to request access to their personal data, rectify them, delete or limit their processing or object to their processing and the right to data transfer.

The purposes of processing personal data and the legal basis for processing

Personal data processed in the CCTV system are processed in order to:

- ensure the safety of persons and property protection, including to secure medical records and other information, based on the provisions of art. 6 par. 1 (c), (d) and (f) and art. 9 par. 2 (h) of the General Data Protection Regulation 2016/679 (GDPR),

- ensure the possibility of constant observation of patients from the nurse's desk – in relation to separate hospital rooms, based on the provisions of the Regulation of the Minister of Health of November 22, 2013 on guaranteed services in the field of hospital treatment.

 

Providing personal data is a requirement to stay in the area of MAVIT MC facilities and is necessary to achieve the objective.

 

Categories of personal data processed

In the CCTV system, the image of people, dates and time of appointments, vehicle registration numbers are processed.

 

Information about recipients of personal data

Personal data processed in the CCTV system may be transferred to entities authorized under the law.

 

The period of data storage

Personal data processed in the CCTV are stored for a period not longer than three months. In the case where the image recordings are evidence in the proceedings or the administrator obtains information that they can constitute an evidence in the proceedings, the storage period may be extended until the final conclusion of the proceedings.

Persons whose personal data is processed in the CCTV system have the right to request access to their personal data, rectify them, delete or limit their processing or object to their processing and the right to data transfer.

- for a period of one year counted from the last day of the year in which the candidate entrusted his/her MAVIT MC data, in the case of persons who agreed to processing of their personal data for the purposes of future recruitment processes.
